§ 68-212. Appeal of suspension or revocation.

  • (a)

    Any wrecker or towing service's approval and authority to respond to police requests which is suspended or revoked by the chief of police may appeal such suspension or revocation to the finance, administration and operations committee of the city by filing a written notice of appeal with the chief of police within five days of receipt of the notice of suspension or revocation. The filing of such notice of appeal shall stay the effect of such suspension or revocation until a hearing is held before the committee at its next regular meeting; provided, however, that if the committee renders a decision upholding the suspension or revocation, the wrecker or towing service may appeal such decision to the entire city council of the city at its next regular meeting.

    (b)

    The finance, administration and operations committee shall have the power to reverse, alter, modify, uphold or increase any suspension or revocation ordered by the chief of police. The city council shall have the power to reverse, alter, modify, uphold, or increase any suspension or revocation ordered by the chief of police or the committee.
